Terms of Service

1. The service

Poplog is a subscription web app operated by the Poplog team ("we", "us", "our"). It lets music fans catalog concerts, records, lyrics, Wishlog items, memories, Looplog posts, and other music-related content in private, organized rooms.

2. Acceptance

By creating an account or continuing to use Poplog, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

3. Authority and eligibility

• You must be at least 13 years old to use the service.
• If you are using the service on behalf of a business or organization, you confirm that you have authority to bind that organization to these terms.
• If you are signing up as an individual, you confirm that you are of legal age to enter into a binding contract in your jurisdiction.

4. Accounts and credentials

• You are responsible for keeping your login credentials safe and for all activity that happens under your account.
• You must provide accurate information when you sign up and keep it up to date. One account is intended for one person.
• Notify us immediately if you suspect unauthorized access to your account via our contact support page.

5. Subscriptions and payments

Payments are securely processed by Stripe. By subscribing you also agree to Stripe's Consumer Terms.

• The free tier is free forever and is limited to the number of items shown on the pricing page.
• Poplog+ is billed monthly or annually at the price shown at checkout. Prices are in USD unless otherwise stated. Taxes may apply and will be calculated at checkout based on your location.
• Subscriptions renew automatically until you cancel.
• You can cancel anytime from Settings → Manage plan. Access continues until the end of the current billing period.

6. Refund policy

If you believe you were charged in error or would like to request a refund, reach out via our contact support page and we will review your request.

7. Your content

• You keep ownership of any text, images, or other content you add to your rooms.
• You grant Poplog a limited, non-exclusive license to store, display, back up, and process your content solely so we can provide the service to you.
• Do not upload content you do not have the right to use. Do not paste large excerpts of copyrighted lyrics — the Lyriclog is intended for your own short notes and quotations.
• You are responsible for the content you create and for ensuring it does not violate these terms or any third-party rights.

8. Acceptable use

You must not use Poplog to:

• Break any applicable law or regulation.
• Commit fraud, send spam, or impersonate another person.
• Infringe intellectual property or other third-party rights.
• Interfere with the security or operation of the service, including uploading malware, probing for vulnerabilities, scraping, reverse-engineering, or circumventing technical limits.
• Upload illegal, hateful, harassing, defamatory, or sexually explicit content.
• Upload content that exploits or harms minors.

We may remove content or suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations.

9. Plaquelog and AI-generated content

• Plaquelog uses an AI service to turn the description you submit into personalized plaque text. Generated results may be inaccurate, incomplete, or unexpected.
• You are responsible for reviewing a plaque before copying, publishing, or relying on it. Do not submit sensitive personal information or content you do not have the right to use.
• We may limit or suspend AI features to protect the service, comply with provider policies, or manage unusual or abusive usage.

10. Intellectual property

Poplog, its software, design, branding, and documentation remain our property or the property of our licensors. Nothing in these terms transfers ownership to you beyond the limited, non-exclusive, non-transferable right to use the service on your active plan.

You may not:

• Reverse-engineer, decompile, or disassemble any part of the service.
• Resell, redistribute, or sublicense access to the service.
• Circumvent plan limits or access controls.

11. Service level and warranties

The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted, error-free, or completely secure performance. Some features depend on third-party services such as Google Sign-In, Apple Sign-In, Stripe, the Cover Art Archive, and MusicBrainz.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, goodwill, or business interruption. Our aggregate liability is capped at the total amount you paid us in the 12 months preceding the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where required by law.

13. Indemnity

You agree to indemnify and hold harmless Poplog and its operator from any claims, damages, or expenses arising out of your content, your use of the service, or your violation of these terms.

14. Termination

You can delete your account at any time from Settings. On termination, your right to use the service ends immediately. We will delete or anonymise your personal data in line with our Privacy Policy, except where we need to retain records for legal, tax, or fraud-prevention purposes.

15. Governing law and disputes

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising from these terms or the service will be resolved in the state or federal courts located in California.

16. Assignment

You may not assign or transfer these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, or sale of assets.

17. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including internet outages, third-party service failures, natural disasters, or government actions.

18. Changes to these terms

We may update these Terms & Conditions as the service evolves. Material changes will be surfaced in the app or by email where appropriate. Continued use after changes means you accept the updated terms.
